Duo Charged In iPhone Cheating Case

By Hj Ahmed Shaheeb

Bandar Seri Begawan - Two locals, Khairul Azli bin Japar, 27, and Suhardy bin Musa, 31, were charged with cheating by dishonestly inducing the delivery of a property, an Apple iPhone, which is an offence punishable under Section 420 of the Penal Code, Chapter 22 read with Section 34.

They can be imprisoned for a term, which may extend to seven years and are also liable to a fine. Sentencing will be heard at a later date.

Before the magistrate, the defendants pleaded guilty to all the charges against them.

Asked why they had committed the crime, they said that they did so on impulse. However, they contradicted themselves later when one of them admitted that they had planned to steal the Apple iPhone and sell it to pay off a debt.

According to deputy public prosecutor, Chris Ng, at the time of the offence, Khairul Azli was working at the Sports Instructors Unit of the Hassanal Bolkiah Stadium under the Department of Youth and Sports, while Suhardy was unemployed.

Sometime before committing the crime, the defendants looked on brudirect.com for individuals who were selling mobile phones with the intention to cheat them of their mobile phones.

They found an individual, who was selling an Apple iPhone. Upon contacting the number they obtained from the classified section, they arranged to meet with the victim at Gadong Centrepoint to discuss the sale of the phone.

On June 10, 2008 at about 9.50pm, the defendants made their way to Gadong Centrepoint in a car. They parked at the back of the building. Khairul Azli met with the victim at the piano lounge located on the first floor, while Suhardy waited in the car.

At the piano lounge, Khairul Azli and the victim agreed on a price for the phone. However, Khairul Azli the told the victim that he wanted to show the phone to his "wife" first to see if she was agreeable to buying it. He concocted the story as part of the plan to deceive the victim with full knowledge that it was not true and that his wife was nowhere near the scene that night.

The victim agreed to the request and accompanied Khairul Azli to the car where Suhardy was waiting. At the car park, Khairul Azli got into the passenger seat of the car and Suhardy drove off. The victim gave chase, however was unable to catch up with the car.

The two defendants went to their friend's flat where they slept for the night before being dropped off at their respective houses the next morning. They gave the Apple iPhone to their friend.

The victim, however, remembered the registration number of the vehicle used by the defendants which led to the arrests of Khairul Azli on August 9, 2008 and of Suhardy two days later.
